ProZone Terms & Conditions

Find below a list of the terms and conditions associated with Future Fit Training's ProZone

1. The membership contract

1.1. When you agree to the terms and conditions online or by phone you are agreeing to join the Future Fit ProZone which, if accepted by us, will result in a legally binding contract.

1.2. You may not transfer any of your rights and obligations under these terms and conditions to another person.

1.3. To fully utilise the ProZone service, we recommend you hold a Level 3 Personal Trainer qualification due to the level of content. By agreeing to these terms and conditions you acknowledge this recommendation.


2. Member Subscription and Fees

2.1. Your member subscription type and associated fees are decided by you when signing up to the ProZone platform.

2.2 . Your fees are for the entire service, whether you choose to only use parts of this service is entirely up to you.

2.3. Both monthly and annual subscriptions operate on an auto-renew basis. Payments will continue to be taken until you terminate your subscription. (See point 3 for further details.)

2.4. Future Fit reserve the right to amend the monthly subscription payment date or terms and will provide you with 30 days’ notice of the changes

2.5. Future Fit Training reserves the right to take matters relating to non-payment of invoices, fees, unauthorised distribution of content and similar cases to the County Court. Any dispute arising under or in connection with this contract which Future Fit Training determines to be more appropriate to be dealt with by other means shall be referred to arbitration by a single arbitrator appointed by agreement or nominated on the application of either party by the President for the time being of the Law Society for England and Wales.


3. Cancelling your membership

3.1. You have the right to cancel your membership within the initial term providing we receive the request in writing within 14 days of signing up.

3.2. If you cancel within the first 14 days of your initial term, you will be provided with a refund of any fees paid, provided you have not utilised any of the membership benefits as laid out in point 4.1. Should you have been found to have utilised these benefits, we reserve the right to keep any fees paid up to and including the full value of one month’s membership

3.3. If you cancel within 14 days, and you have used your ProZone discount to book a course, Future Fit reserve the right to revoke your CPD discount and you will be required to pay the balance if you wish to continue with the course.

3.4. Following your initial 14-day period, and if you have an annual subscription, no cancellations or refunds will be permitted. To stop the auto-renewal of your annual subscription, you must cancel your plan a minimum of one day before your next payment is due via the ‘Account’ within your ProZone account.

3.5. If you have a monthly subscription, you can cancel at any time via the ‘Account’ page within your ProZone account. No refunds will be issued once a monthly payment has been taken. No partial refunds will be issued in circumstances where membership is cancelled partway through a month.

3.6. Upon cancellation, termination or expiry of your contract/subscription, whereupon you are no longer a ProZone member, all access to services provided under the terms of this contract including but not limited to access to the ProZone Platform, ProZone content, any offers or discounts or any other agreed service will be terminated. This term supersedes any other agreed length of access within this contract.

3.7. If you stop paying during your membership, we reserve the right to suspend access to your CPD courses until you resume paying.


4. Membership benefits

Upon joining the ProZone, you will receive the following membership benefits:

4.1. A minimum of 24 CIMSPA accredited CPD points per year delivered in the form of Video Presentations and Articles adhering to the following points structure:

Video Presentations
15 Minutes: 0.25 CIMPSA Points
30 Minutes: 0.50 CIMSPA Points
45 Minutes: 0.75 CIMSPA Points
60 Minutes: 1.00 CIMSPA Points

Articles
800-1000 Words: 0.50 CIMPSA Points
1000+ words: 0.75 CIMSPA Points

4.2. Additional regular training resources such as short videos, articles and downloadable documents

4.3. 25% discount off all Future Fit Training CPD courses – we will add a monthly document into the ProZone regarding all upcoming CPD courses that you can book onto. Alternatively, you can book online using your ProZone membership number which can be found in the ‘Account’ section of your ProZone Platform.

4.4. Access to our private ProZone Facebook group which provides membership to an exclusive online community of like-minded professionals and industry experts and other useful resources.

4.5. We reserve the right to change the membership benefits as laid out in point 4.1 at any time for an alternative of an equal or greater value without prior notice

4.6. The additional benefits laid out in point 4.2 are not guaranteed as part of your ProZone membership and Future Fit Training reserves the right to remove or replace these at any time without prior notice

4.7. Future Fit will make reasonable attempts to deliver both accredited Video Presentations and Articles on a monthly basis but reserve the right to deliver just Video Presentations or Articles on a particular month providing a minimum of 2 CIMPSA points are delivered.



5. Obtaining CIMSPA CPD points

5.1. As described in 4.1), CIMSPA accredited video presentations and articles will be published on the ProZone platform each month whereby once complete, you can claim a CIMSPA CPD or fraction thereof by:

- Watching at least 90% of a chosen video presentation to unlock an exam which you must pass by answering 100% of the questions correctly.

- Confirming that you have read an article to unlock an exam which you must pass by answering 100% of the questions correctly.

5.2. In order to receive your CIMSPA point, you must be a member of CIMSPA, and the cost of this membership is your responsibility. To find out more about the CIMPSA membership, it’s benefits and terms and conditions, please visit https://www.cimspa.co.uk/.

5.3. If you are a CIMPSA member, Future Fit will automatically submit your accredited CPD points to CIMPSA on a monthly basis but only if you provide your CIMPSA membership number in the ‘Account’ section of your ProZone account.

5.4. Future Fit shall not be responsible for submitting CPD points to CIMPSA where you have not provided your CIMSPA membership number in the ‘Account’ section of your ProZone account.7

5.5. Future Fit shall submit CIMSPA CPD points achieved to CIMSPA between the 1st and 7th of each month for the previous month’s points achieved. Future Fit shall not be responsible for any delays in CPD being displayed on CIMSPA’s systems following our submission.

5.6. Any feedback or evaluation provided by you may be used for promotional purposes.


6. Receiving your discount on CPD courses

6.1. You will be allocated a unique membership number upon joining the ProZone which should be used as your own personal discount code to be applied when purchasing any of our CPD courses in order to receive your 25% discount.

6.2. You must present your unique membership number at the time of purchase in order to obtain your discount. Future Fit Training reserves the right to refuse to apply any discounts once a course is purchased.

6.3. Your 25% discount cannot be applied in conjunction with any other discounts or offers.

6.4. Your 25% discount is only eligible on CPD courses up to the value of £750 maximum per calendar month before discounted prices.

6.5. The 25% discount is not valid on complete Diplomas.


7. Changing the agreement

7.1 We reserve the right to withdraw or amend the service and will give 30 days’ notice of any changes.

7.2. If we must withdraw this service, the minimum term for this contract no longer applies and you will be provided with a refund for any month’s services that you have paid for that we will no longer fulfil.

7.3. If we make any changes to the provision of membership benefits that we are unable to replace with another benefit of equal or greater value, we will contact you and you may be offered the opportunity to cancel your contract within the minimum term.


8. Online community unauthorised use

8.1 You must not use this online community in any manner or for any purpose which constitutes or facilitates unauthorised use, and you will indemnify ProZone for any losses sustained as a result.

8.2. Future Fit Training reserves the right to remove or edit any material that it considers, in its sole discretion, constitutes unauthorised use.

8.3. Future Fit reserve the right to remove any members from the online community if they are seen to be acting inappropriately.

8.4. or the purposes of these terms, "unauthorised use" means the use of this online community that:

  1. Is unlawful, false, misleading, a breach of confidentiality or privacy infringes any intellectual property rights or in any manner violates the rights of the ProZone or any other person
  2. Is inappropriate, offensive, obscene, defamatory, malicious, discriminatory, harasses or is likely to cause distress or inconvenience to any person
  3. Is technically harmful to the online community or attempts to circumvent security measures
  4. Otherwise breaches these terms

9. Data protection and use of personal data

9.1 As a ProZone member all personal data that you supply will be used to process your membership subscription. As a member, your data will be used for marketing, statistical and analytical purposes and to administer your membership. You will receive membership communications and from time to time we will let you know about promotions.

9.2. You are able to opt out of marketing and promotional emails from Future Fit Training by emailing prozone@futurefit.co.uk. However, you will still receive emails regarding your membership and ProZone account.

9.3. Due to the complexity of the software and processing requirements, the following data subprocesses’ will be used in the delivery of the agreed products and services in this contract:

  1. Stripe Payment Solutions: (https://stripe.com/dpa/legal)
  2. SendGrid/Twillo: (https://www.twilio.com/legal/data-protection-addendum)
  3. Digital Ocean: (https://www.digitalocean.com/legal/gdpr/)

The Training Provider is required to ensure that any sub-processors that they provide data to within the scope of this contract will treat the data in accordance with GDPR

10. Queries, comments and complaints

10.1. We will respond to any complaint or query received within three working days. This may be an acknowledgement that we have received a complaint whilst further investigations are carried out.

11. Declaration

11.1. By accepting the terms and conditions, you are agreeing to:

  1. Enter into a legally binding contract with Future Fit Training Limited
  2. Pay all monies due on the agreed date(s)
  3. The understanding that whilst you may have received advice to help you make this choice, the ultimate decision was yours
