1. General Terms
1.1. By signing up to ReActivate platform, a product of Future Active Workforce CIC (FAW) you are agreeing to the terms and conditions laid out below.
1.2. This agreement shall commence on the date of launch of the platorm shall continue for a period of twelve months at which point the subscription to the platform must be renewed or terminated.
1.3. You must ensure that the details provided by you on registration or at any time are correct and complete and you must inform us immediately of any changes to the information that you provide when registering by updating your personal details to ensure we can communicate with you effectively.
1.4. We may suspend or cancel your registration with immediate effect for any reasonable purposes or if you breach these terms and conditions.
1.5. When you register on this platform, you will be asked to create a password, which you should keep confidential and not disclose or share with anyone. If we have reason to believe that there is or is likely to be any misuse of the Website or breach of security, we may require you to change your password or suspend your account.
1.6. You may not transfer your access or share your logins with any other persons regardless of whether they have access or rights to access or not. The security of your log in is your responsibility and you should keep your password secure and change regularly.
1.7. You can cancel your access to ReActivate at any time in the account section once logged into the platform.
1.8. The ReActivate platform is Free of charge for anyone working or volunteering in the sport, fitness, leisure and physical activity sector in England. By signing up you are confirming that you are currently working or volunteering in the sport, fitness, leisure and physical activity sector in England.
1.9. If you are not working or volunteering in the sport, fitness, leisure and physical activity sector in England you may be charged a fee for the use of the platform.
2. Content Provision
2.1. As a ReActivate User, you will gain access to a range of content from Sport England, CIMSPA, Future Active Workforce, Future Fit Training, Right Directions, Sports Structures and other selected partners. This will include but not be limited to presentations, videos, blogs and articles.
2.2. All of the content is delivered by experts within their specified fields, and every effort will be made to keep this updated. However, due to the fast-changing nature of the COVID-19 situation, government advice should always be considered to supersede any content hosted on the platform. All content is correct at time of publishing.
2.3. You may also receive additional content created and uploaded from your employer organisation (if you are accessing the platform via your employer) or organisations in the wider sector.
2.4. As part of the agreement between ReActivate and your operator (operator platforms only), your operator has agreed that the content they upload follows health and safety procedures in terms of suitability/safe instruction / PPL adherence. More specifically that:
I. The content they provide Is delivered by a qualified and competent person working within their area of knowledge and expertise and they apply relevant health and safety advice.
II.Public Liability Insurance is valid and current.
III.Their content gives the usual health declaration disclaimer as per the usual screening.
IV.Their content has been reviewed for suitability bearing in mind their responsibility to you.
V. Any music they use is licensed as per PPL/PRS rules.
This platform may contain links to external sites. Unless expressly stated, these sites are not under the control of Future Active Workforce or that of our affiliates. We assume no responsibility for the content of such Websites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this Website does not imply any endorsement of the sites themselves or of those in control of them.
3. Intellectual Property
3.1. All Content included on the ReActivate platform, unless uploaded by Users, is the property of FUTURE ACTIVE WORKFORCE, our affiliates or other relevant third parties. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this platform, including any such content uploaded by Users.
3.2. By continuing to use the platform you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this platform shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner's prior written permission
3.3. You may, retrieve, display and view the Content on a computer screen or mobile device. You must not otherwise reproduce, modify, copy, distribute or use for commercial purposes any Content without the written permission of Future Active Workforce.
3.4. We welcome you're feedback, ideas or suggestions but you agree that we may use your Feedback without any restriction or obligation to you, even after this agreement is terminated. This Section does not limit or affect any rights you may have under applicable data protection laws.
4. Prohibited Use
You may not use the Platform for any of the following purposes:
I.in any way which causes, or may cause, damage to the Platform or interferes with any other person's use or enjoyment of the platform;
II.in any way which is harmful, unlawful, illegal, abusive, harassing, threatening or otherwise objectionable or in breach of any applicable law, regulation, governmental order;
III.making, transmitting or storing electronic copies of Content protected by copyright without the permission of the owner.
5. Usage Disclaimer
5.1. By entering the ReActivate platform and using the accessible content, you are agreeing to accept all parts of the terms and conditions. Thus, if you do not agree to this, discontinue use of our service immediately, and do not use our platform, website, blog, videos, programs, services, or products.
5.2. By using this website, blog, e-mails, or any of our programs, services, or products, you implicitly signify your agreement to all parts of this document.
5.3. Sport England, CIMSPA, Future Active Workforce, Future Fit Training, Right Directions, Sports Structures and other selected partners will not be held responsible in any way for the information that you receive through the ReActivate platform. In no event will any of the parties mentioned be liable to any party for any direct, indirect, special, incidental, equitable or consequential damages for any use of or reliance on the content provided on the ReActivate platform, including personal injuries, accidents, misapplication of information or any other loss, malady, disease or difficulty, or otherwise, even if we are expressly advised of the possibility of such damages or difficulties.
5.4. All of the named parties strongly recommend that you consult with your doctor before beginning any exercise program. You should be in the good physical condition and be able to participate in exercise. None of the content providers are licensed medical care providers and represents that it has no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise on a medical condition.
5.5. You should understand that when participating in any exercise or exercise program, there is the possibility of physical injury. If you engage in this exercise or exercise program, you agree that you do so at your own risk, are voluntarily participating in these activities, assume all risk of injury to yourself, and agree to release and discharge the named parties from any claims or causes of action, known or unknown.
6. Data Protection
6.2. 'Data Protection Laws' means any applicable law relating to the processing of Personal Data, including, but not limited to the Directive 95/46/EC (Data Protection Directive) or the GDPR. 'GDPR' means the General Data Protection Regulation (EU) 2016/679. 'Data Controller', 'Personal Data' and 'Processing' shall have the same meaning as in the GDPR. We are a Data Controller of the Personal Data we Process in providing the Services to you.
6.3. Where you supply Personal Data to us so we can provide Services to you, and we Process that Personal Data in the course of providing the Services and Goods to you, we will comply with our obligations imposed by the Data Protection Laws:
I.before or at the time of collecting Personal Data, we will identify the purposes for which information is being collected
II.we will only Process Personal Data for the purposes identified
III.we will respect your rights in relation to your Personal Data
IV.and we will implement technical and organisational measures to ensure your Personal Data is secure.

7. Use of Personal Data
7.1. As a ReActivate registrant, all personal data that you supply will be used to process your training, to administer your use, awarding of the certificate and for data and statistical purposes.
7.2. We may also use your data for the following reasons: to improve your experience by personalizing the platform and to improve our service offerings; , and for statistical and analytical purposes ; .
7.3. Your data, including your name and e-mail address, will be passed to and held by the Chartered Institute for the Management of Sport and Physical Activity for the purpose of recording the award of the ReActivate digital certificate and for sharing professional development opportunities.
7.4. We will also use your data to contact you based on the opt-in choices you made on registration.
7.5. We do not share your personal information with anyone outside of our associated companies or listed partners for marketing purposes.
7.6. You can ask us to stop sending you marketing messages at any time by following the “unsubscribe” links on our marketing communications, or emailing firstname.lastname@example.org at any time.
7.8. Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of the provision of a service to you.
8. Queries, comments and complaints
8.1. We will respond to any complaint or query received within three working days. This may be an acknowledgement that we have received a complaint whilst further investigations are carried out.
